Terms And Conditions
These general terms and conditions apply to all agreements between DriveSimSolutions and the customer, throughout this document the terms “we”, “us” and “our” refer to DriveSimSolutions. If needed, special terms and conditions will be provided. The terms and conditions should be read together with the privacy regulation, as found on our website at www.drivesimsolutions.store. If any provision of these Terms and conditions is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein. DriveSimSolutions is permitted to revise these Terms and conditions at any time as it sees fit.
Acceptance of terms and conditions
The acceptance of an offer or placement of a purchase order invokes the acceptance of our terms and conditions. Upon signature of an offer or placing an order in the webshop, the customer declares to have fully read and accepted the terms and conditions. these terms and conditions replace any previous terms and conditions and apply and prevail regardless of the terms and conditions of our customers.
Unless otherwise stated on the offer itself, all elements of these general terms and conditions apply to every offering on the DriveSimSolutions webshop
Prices, as presented in the webshop are subject to change, without previous notice. All prices, as listed in the webshop, are with VAT (21%, according to Belgian rates) included and in Euro (€), unless specifically stated otherwise. Additional fees might be charged for customs formalities (import – export) depending on the buyers’ country, these fees are not included in the offer and need to be payed for by the buyer at their country.
Delivery times, as listed in the webshop, are purely indicative. DriveSimSolutions will do all within its power to adhere to indicated delivery time but cannot be held responsible for delays as a result of supplier delay or as a result of Force Majeure.
An offer is considered accepted upon placing the order in the webshop.
Placement of a purchase order automatically creates a contract that binds the customer to purchase of all the products listed on the purchase order or chechout page. At any point in time can this contract be one-sidedly terminated by DriveSimSolutions upon written notice.
Unless stated otherwise, payment terms for products purchased through the DriveSimSolutions webshop are: 100% payment on placement of the order or acceptance of the offer, the payment should include any delivery charges.
Processing of the webshop order will not start as long as payment of the entire amount has not been received.
Any dispute concerning the Agreement, or the performance or interpretation thereof, that cannot be settled via DriveSimSolutions is within the exclusive jurisdiction of the courts in Antwerp, Belgium as the place where the obligation has come into being.

Delivery and Shipment
Unless stated otherwise, all listed prices are without delivery costs included. Delivery charges must be payed upon placement of the order. Delivery charges are based on geographical location. DriveSimSolutions has the freedom to choose a carrier and shipment method. Specific shipment methods can be requested by the customer; in this case the customer will be charged the additional customary costs.
DriveSimSolutions reserves the right to make partial deliveries, at no extra costs, when this appears to be advantageous for speedy handling. One shipment may include multiple parcels.
DriveSimSolutions holds the risk for shipment of the goods until delivery is complete. In the case of returns as part of warranty claim, the return shipment should be requested by DriveSimSolutions to the customer. The customer then carries the risk, as well as the transport costs, until all goods have been received by DriveSimSolutions.
DriveSimSolutions warrants the simulator hardware against defects in materials and workmanship under normal use for a period of twenty-four (24) months from the Delivery Date, on the condition that the Hardware has been completely paid for. The metal parts, as used for our products are of industrial quality, some minor scratches or other light damage or handling marks could be present.
DriveSimSolutions disclaims all other warranties, including without limitation: fitness for a particular purpose, or against hidden or latent defects. DriveSimSolutions’ responsibility for warranty claims is limited to repair or replacement. DriveSimSolutions reserves the right to modify this Warranty at any time, with notice to Customer.
This Warranty is voided immediately of repair, modification, alteration or other service is attempted by anyone other than DriveSimSolutions.
The customer is expected to perform inspection of any new product immediately after delivery or installation. The customer will have a 10-day period to notify DriveSimSolutions and provide evidence that any damages/flaws to or missing of the product was already present upon delivery of the product. Should this be the case, DriveSimSolutions should be notified immediately. In the case that the claim is justified, DriveSimSolutions will justify this claim by repairing or replacing parts. Any missing parts will be sent to the customer at the expense of DriveSimSolutions. When the 10-day period after delivery/installation is over, the right of guarantee for these types of damages/flaws/missing parts no longer applies.
DriveSimSolutions offers technical support to customers who hold an active support contract. A support contract is considered active only when complete payment for the contract term has been fulfilled.
Technical support is limited to solving of technical issues related to Drivesimsolutions products and does not include any new development of software and/or hardware.
The technical support contract includes only support on distance by means of e-mail, phone and other distance communication methods. Additional travel costs related to interventions as part of the technical support contract are to be paid for by the customer. The technical support contract will be automatically renewed at the end of each term for a further term of one (1) year unless either party gives the other written notice of termination at least 7 days prior to the end of the relevant term.

By using the DriveSimSolutions website and/or webshop, accessible at drivesimsolutions.store you agree to the website and webshop section of our general terms and conditions. If you disagree with the website and webshop section in these terms and conditions, you must not use our website and/or webshop.
By registering an account on our website, the information provided as customer must be true and accurate. Using an identity, alias or company name/details other than your own is not allowed.
Other than the content you own, under these Terms, DriveSimSolutions and/or its licensors own all the intellectual property rights and materials contained in this Website and webshop

The operator is expected to be familiar with the equipment and bears the responsibility for safe operation. The operator should always check the equipment for mechanical and electrical functionality. If requested, DriveSimSolutions can provide an offer for training on the safe operation of DriveSimSolutions equipment.
